AuraConnect, SmartLoop, SmartCast applications and websites www.aurabyopus.com and www.opus-technologies.frare services offered by Audiofils SARL (SIRET 793 798 661), enabling users to manage the installation and configuration of products in the Aura by Opus and Opus Technologies ranges on behalf of installers, local authorities or operators.

These tools offer a simplified interface for accessing information, configuring products, or transferring installation responsibilities. Payments are made by credit card via a secure interface, depending on the options offered by the company.

2. Warning

The user declares that he/she has read and understood these General Terms of Use (GTU) and the technical and legal implications of accepting them.

Use of the AuraConnect, SmartLoop or SmartCast applications or websites implies full acceptance of these GTC.

Warning: The use of these services while driving or in inappropriate conditions is strictly discouraged. Audiofils cannot be held responsible for any damage resulting from careless or illegal use of the services.

3. Definition

• AuraConnect, SmartLoop, SmartCast: mobile or web applications dedicated to the management of Aura by Opus products and technical studies prior to installation.
• User account: personal space allowing access to service functionalities, created on the application or websites.
• Service: functionalities offered by the application or websites to configure or manage products.
• Personal data: any information relating to an identified or identifiable natural person in accordance with the RGPD.

4. Object

These Terms and Conditions define the rules for accessing and using the services offered by Audiofils via the AuraConnect, SmartLoop and SmartCast applications and websites.

These services include :

• Aura by Opus product management.
• Technical study prior to product installation
• Access to certain data on the Opus Technologies and Aura By Opus brands
• Simplified equipment configuration.
• Managing transfers between owners and installers.

5. Acceptance of T&Cs

Any use of the AuraConnect, SmartLoop, SmartCast applications or websites www.aurabyopus.com and www.opus-technologies.fr implies full and complete acceptance of these Terms and Conditions.

The user acknowledges having read the GCU at the time of registration or first access to the services.

6. Modification of the GCU

Audiofils SARL reserves the right to modify these GCU at any time. Changes will be notified via the application or websites. Continued use of the services after modification constitutes acceptance of the new conditions.

7. Account creation and management

To access the services, the user must create an account by providing the following information:

• Email address.
• User name (login).
• Phone number.
• Personal PIN code.
• Postal address.

The user undertakes to provide accurate information and to keep it up to date. Any fraudulent use or communication of false information will result in the suspension or deletion of the account by Audiofils.

8. Use of services

The applications and sites allow the user to :

• Configure Aura by Opus products.
• Transfer responsibilities between installers and owners.
• Access support services.
• Technical study prior to product installation
• Access to certain data on the Opus Technologies and Aura By Opus brands

The information entered by the user must be accurate, under penalty of liability for errors or malfunctions.

9. Rates and payment

Basic services are free, but some advanced features may be subject to a charge. Payment, when applicable, is made via a secure platform in euros.

A payment history is available in the user area.

10. Liability

Audiofils is liable only for direct damage caused by its negligence or wilful misconduct. It cannot be held liable for :

• Service interruptions or data loss caused by third parties.
• Errors resulting from fraudulent use of a user account.
• Technical failures or losses due to force majeure.

11. Intellectual property

All content (text, logos, images, software) of the application and sites is the exclusive property of Audiofils SARL. Any unauthorized reproduction or use is prohibited and constitutes an infringement.

12. Personal data

Personal data collected is processed in accordance with the RGPD. Users may exercise their rights of access, rectification or deletion by contacting contact@opus-technologies.fr.

13. Closing the account

Users may request the closure of their account at any time by contacting contact@opus-technologies.fr. Audiofils reserves the right to suspend or terminate an account in the event of non-compliance with these GCU.

14. Dispute

These GCU are governed by French law. In the event of a dispute, the parties will endeavor to find an amicable solution. Failing this, the dispute will be referred to the competent courts within the jurisdiction of the Bordeaux Commercial Court.
